Terms and Conditions.

By completing an order form you automatically agree to abide by the following terms and conditions. Failure to follow these policies can result in the suspension or termination of your account.

All Clients » must

• Be the person they claim to be.
• Provide accurate and up-to-date information.
• Provide enough information to complete the project. Failure to do so will result in a fine of 15% of the total price each month until the project can be completed or the client cancels in writing.
• Provide full payment for services rendered by Sequin Studio.

Design & Copywriting » You Must

• Either be the copyright holder or have permission of the copyright holder to use any photographs, sound or video clips on your website and agree to hold harmless, protect and defend Sequin Studio, and it's subcontractors, from any claim, suit, tax or penalty that may arise from the your (the client's) exercise of Internet electronic commerce.
• Provide me with sufficient information/data to be able to complete your commission.
• Place a visible credit and link back to Sequin Studio on your website, preferrably where Sequin Studio placed it.
• The client is responsible for the purchase of any neccessary license fees.

Design » General

• Sequin Studio guarantees that all websites and coding produced will meet the W3C (X)HTML and CSS standards current at the time of production.
• Sequin Studio guarantees that each website produced will be tested, and found to work, on both PC and Mac platforms as well as a minimum of four different web-browsers and at least one text-based browser. This guarantee does not cover AOL or any requested special effect that we have advised you against.
• The addition of Meta Tags, submission of a site to search engines and maintenance updates will only begin after full payment has been received. Full payment confirms that the project has been completed to the clients' satisfaction.
• It is preferred that any Audio/Visual material required to be added to a site is sent on disk. It ensures the best possible quality. However, you can send mp3s and video files attached to an email, in which case the size of such files is limited to 5mb each.

Hosting » You Must

• Back up your own data.
• Use only the newest releases of scripts.

Hosting » You may Not

• CHMOD any files or folders to 777.
• Place illegal, inappropriate or abusive content on your website. Including, but not limited to: MP3s, racist, hate sites, warez, IRC or IRC bots etc.
• Spam.
• Publish or endorse Pornography.
• Use any of the following scripts: Greymatter, formmail or any out-of-date/unsafe scripts or tutorials.

Hosting » General

• Failure to renew your hosting plan when the initial period expires will result in cancellation of your hosting.
• Sequin Studio will endeavour to set up new accounts within 48 hrs.
• This process may be delayed as a result of unforseen circumstances with mail servers or your ISP.
• On receipt of your order an e-mail will be sent containing details of how to pay and asking for necessary information. This will be followed by a further email containing your account details once payment has been received.

Maintenance

• The clients must pay in full before any maintenance work can commence.
• It is preferred that any Audio/Visual material required to be added to a site is sent on disk. It ensures the best possible quality. However, you can send mp3s and video files attached to an email, in which case the size of such files is limited to 5mb each.

Domain Names

• Once purchased, domain names cannot be cancelled.
• Clients are responsible for the renewal of any domain names registered by us, unless they are on The Full Monty or The Set Up packages, in which case we will renew the domain name as soon as we have received payment for the year ahead.
• If your domain name was registered via Sequin Studio, you will be informed as to when it is due for renewal and you may do so or let it expire.

Payments

• For design and copywriting projects a 40% deposit is required before I will commence work, half of which is non-refundable. This does not include the purchase of domain names, which are all non-refundable. Upon completion of the project, the remaining 60% is due before the web site goes live. For non-design projects, full payment is required before any work will commence.
• Payments can only be made via PayPal.
• If collection proves necessary, the client agrees to pay all fees incurred by that process. This agreement becomes effective when client retains the designer with a deposit.
• All payments must be made in Pounds Sterling (£). For residents outside the United Kingdom, paypal provides the option to send payment in multiple currencies.
• There is a £25 penalty charge if payments are more than 30 days late.

Cancellations and Refunds/Account Termination

• You can cancel your account at any time. For design/copywriting clients the refundable 20% of your deposit will be refunded to you. For hosting clients a prorated refund can be issued upon request.
• No refunds will be issued if abuse of our stated policies forces the premature suspension or termination of your services.
• Upon receipt of your cancellation request, your site will be removed from our servers within 14 days.

Liabilities

• Sequin Studio makes no endorsement, promise or claim regarding any service offered by our clients and will not be held liable for any disputes or claims against said clients.
• Sequin Studio shall not be held liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use of a client's website or from any information, services or products provided through a client's website.
• Sequin Studio shall not be held responsible for any claimed damages, including incidental and consequential damages, which may arise from Sequin Studio's servers going off-line or being unavailable for any reason whatsoever. All damages shall be limited to the immediate termination of service.
• Sequin Studio shall not be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Sequin Studio are resold and consequently, certain equipment, routing, software and programming used by Sequin Studio are not directly owned or written by Sequin Studio.

Content

• Sequin Studio believes in freedom of speech. However written, visual or implied content that is violent/malicious/obscene/hate will not be tolerated. If such content comes to our attention, a warning will be issued and if the offending material is not removed within the specified timeframe the account will be terminated.
• The resources and time needed to monitor our clients by checking each individual constantly growing and evolving website is impossible for one freelancer, and as a result we may not be aware of any questionable content. Therefore if you feel something needs addressing, please bring it to Lexa's attention by using the contact form. If we are contacted by a copyright holder with regard to a potential infringement of their own material on a Sequin Studio hosted site, we will require further proof of the origin of the disputed content and copyright before action will be taken.

Delivery

• Web design projects will be delivered upon receipt of full payment in one of 2 ways. Either uploaded directly to the client's hosting service or e-mailled in a .zip file.
• If the client chooses direct upload, the client agrees to provide Sequin Studio with full FTP access to their own hosting account.

General

• We reserve the right to refuse to add any content to a site/graphic if we feel that is illegal, inappropriate or abusive at our sole discretion.
• Extra .zip copies of a clients design project can be purchased for £5.
• Sequin Studio reserves the right to engage subcontractors on any project to ensure the project is completed within a reasonable time-frame and to the specifications agreed.
• Sequin Studio can be hired in advance on a retainer for a specified amount of time at the current hourly rate by purchasing hours in bulk.
• Sequin Studio is not responsible for keeping backups of clients work or sites and cannot be held liable for any loss of data.
• Sequin Studio is not obliged to furnish clients with further copies of their website, design or copy following full payment and delivery of the project.
• Sequin Studio is not responisble for editting any aspect of the work once the client has modified the original content.

Copyright of the Web Design Project or commissioned copywriting is held by Sequin Studio (Lexa). Rights to use the design project as, or comminssioned copy on, a website is assigned to the client once full payment has been received. Sequin Studio (Lexa) reserves the right to display graphics, other design elements or copy as examples of her work in her portfolio.

All clients will follow the above terms as stated. While Sequin Studio makes every attempt to ensure all clients follow the regulations, is not responsible for any content that may be on their clients' websites, and the individual takes responsibility for any material that may be in breach of copyright or any laws.

Violations should be referred to report@sequin-studio.com. All complaints will be investigated promptly.
